1. Acceptance of the agreement on terms of use.
When you create a Serious Dating account, whether through a mobile device or mobile application
(collectively, the “Service”), you will be bound by these Terms of Use, our Privacy Policy and Safety
Tips, all of which are incorporated into this Agreement by reference, and any terms disclosed and
accepted by you when you purchase additional features, products and services that we offer on the
Service (collectively, this “Agreement”). If you do not accept and agree to be bound by all the terms
of this Agreement, do not use the Service.
We may make changes to the Agreement and the Service from time to time. We may do this for a
variety of reasons, including to reflect changes or requirements in applicable legislation, new
features or changes in company working methods. we recommend that you regularly read the
latest edition. It is the latest edition that will apply as the current edition. If the changes include
material changes that affect your rights or obligations, we will give you reasonable notice of the
changes before they come into effect; this can be, for example, a notification via the service or an
e-mail. If you continue to use the Service after the changes take effect, you agree to the revised
agreement.
2. Qualification.
You are not authorised to create an account or use or access the Service unless all of the following conditions are met:
A- You are at least 18 years old.
B- You have never been convicted of a federal felony or misdemeanour (or crime of similar severity), a sex crime, or a crime involving violence, and that you are not required to register as a sex offender.
3. Your account.
To use Serious Dating, you can log in with your Facebook login. If you do this, you give us
permission to access and use certain information from your Facebook account; these include, but
are not limited to, your public Facebook profile and information about Facebook friends that you
share with other Serious Dating users who have given permission for Facebook or Serious Dating
to use their personal data. For further information about the information we collect from you and
how we use it, please read our Privacy Policy.
You are responsible for keeping the login information that you use to log in to Serious Dating
confidential, and you are solely responsible for all activities that occur while using that login
information. If you believe someone has accessed your account, please contact us immediately.
4. Condition for your profile picture account.
A- No kids on their own. They must be in the photo with an adult, and fully clothed.
B- No photos in bikinis/swimwear indoors.
C- No pictures in underwear.
D- No Shirtless/underwear Mirror Selfies.
E- Face must be clearly visible in at least one photo.
F- No watermarks or text overlaid.
G- No pornographic material.
H- No graphic hunting photos.
I- No guns or drugs.
5. Changes to the Service and Termination.
Serious Dating is always striving to improve our service and enable you to access more features
that you may find interesting and useful. This means that we may add new features or
improvements from time to time and that we may remove some features; if these actions do not
materially affect your rights or obligations, we may choose not to inform you of these changes
before we make them. We may even choose to stop offering the service altogether. In this case,
we will inform you of the change in advance, unless intermediary measures apply, such as security
measures, which may prevent us from doing so.
You may choose to delete your account with one month’s notice until the end of the month, for any
reason, by following the instructions under “Settings” in the Service. However, if you use a third
party payment solution, such as Apple’s App Store or the iTunes Store (“App Store”), where this is
possible, you must manage your in-app purchases through your account on that service if you wish
to avoid additional charges . Serious Dating may choose to terminate or delete your account at any
time and without notice if Serious Dating has reason to believe that you have violated this
Agreement. In the event of such termination or deletion, you will not be entitled to any refund for
your purchases. After your account is terminated or deleted, this Agreement will also be
terminated, except for the following sections, which will continue to apply to you and Serious
Dating: Section 4, Section 5, and Sections 12 through 19.
6. Security; your interactions with other members.
Although Serious Dating continually encourages a respectful member experience through feature
such as the double opt-in, which allows members to communicate only if they have both indicated
that they are interested in each other, Serious Dating is not responsible for any Member’s conduct
on the Service or elsewhere. You agree to exercise caution in all your interactions with other
Members, especially if you decide to communicate outside of the Service or if you meet individuals
in real life. In addition, you agree to read and follow the Serious Dating Safety Tips before using the
Service. You agree that you will not share your financial information (such as your credit card or
bank account information), or transfer money to, or otherwise send money to, other members.
You are solely responsible for your interactions with other members. You understand that
serious dating does not perform background checks on its members or otherwise
investigate their backgrounds. SERIOUS DATING MAKES NO REPRESENTATIONS OR
WARRANTIES AS TO THE CONDUCT OR COMPATIBILITY OF MEMBERS.
7. Rights are provided by serious dating.
Serious Dating grants you a personal, worldwide, royalty-free, non-transferable, non-exclusive and
non-revocable license to access and use the Service. This license exists for the sole purpose of
allowing you to use and enjoy the services of the Service as intended by Serious Dating Site and
permitted under this Agreement. This license and any authorisation to access the Service is
automatically revoked if you do any of the following:
1- Use the Service and its content for commercial purposes without our written consent.
2- Copies, modifies, transmits, derives work from, uses or in any way reproduces any material,
images, trademarks, trade names, service marks or other intellectual property protected by
copyright, other content or proprietary information that is available through the Service, without
Serious Dating’s prior written consent.
3- Express or imply that the statements you make are endorsed by Serious Dating. uses any robot,
bot, spider, crawler, scraper, search or retrieval method, proxies or other manual or automatic
device, method or process that allows you to access, retrieve, index, “data mine”, or in any way
reproduce or circumvent the navigational structure or presentation of the Service or the content of
the Service.
4- Use the Service in a manner that may disrupt, interrupt or adversely affect the Service or
servers and networks associated with the Service.
5- Transmit viruses or other harmful code, or otherwise compromise the security of the Service.
6- Forge headers or otherwise manipulate identifiers to disguise the origin of information sent to or
through the Service.
7- “Frame” or “mirror” part of the Service without Serious Dating’s prior written permission.
8- Uses metatarsi, tags, or other entities that contain references to Serious Dating or the Service,
(or any trademarks, company names, service marks, logos, or slogans belonging to Serious
Dating) to redirect individuals to another website for any purpose.
9- Modify, adapt, modify for the purpose of sub-licensing, translate, sell, reverse engineer, decode,
distribute or otherwise disassemble any part of the Service or cause others to do so.
10- Use or develop any third-party programs that communicate with the Service or with other
members’ content or information without our written permission.
11- Use, access or publish the Serious Dating interface to the app’s programming without our
written consent.
12- Investigates, scans or tests the vulnerability of our Service or any of our systems or networks.
13- Encourages or promotes activities that violate the Agreement.
Company may investigate and take any available legal action in response to illegal and/or
unauthorised use of the Service, including termination of your account.
Any software we provide to you may automatically download and install upgrades, updates or other
new features. You can adjust these automatic downloads through your device’s settings.
8. You Grant Rights For Serious Dating
By creating an account, you grant Serious Dating a worldwide, transferable, royalty-free right and
license, sub licensable, to store, use, copy, display, reproduce, adapt, edit, publish, modify and
distribute the information that you authorise us to access through Facebook, as well as any
information that you post, upload, display or otherwise make available, (collectively “Publisher”) on
the Service or send to other users, (collectively “ the content”). Serious Dating’s license to Your
Content is non-exclusive, except that Serious Dating’s license is exclusive to derivative works
created through use of the Service. For example, Serious Dating will have an exclusive license to
screenshots of the Service that include your content. In addition, you authorise Serious Dating to
act on your behalf for the purpose of allowing Serious Dating to prevent the use of your Content
outside the Service so that your Content originating from our Service is not infringed by other
Members or third parties . This expressly includes the authorisation, but not the obligation, to post
notices under 17 USC § 512 (c) (3) (ie, DMCA Takedown notices) on your behalf if your content is
taken and used by third parties outside of the Service. Our license to your content is subject to
your rights under applicable law, (for example, laws relating to the protection of personal data to
the extent that the content contains personal information as defined by those laws), and exists for
the limited purpose of operating, developing, providing and improve the Service and to research
and develop new services. You agree that any content that you post or that you give us permission
to post on the Service may be viewed by other members and may be viewed by any person who
visits or participates in the Service (e.g. (eg individuals who have the ability to receive shared
content from other Serious Dating members).
1- You agree that all information you submit after creating your account, including information
submitted from your Facebook account, is accurate and truthful, and that you have the right to post
the content on the Service and assign Serious Dating the the above license.
2- You understand and agree that we may monitor or review content you post on the Service. We
may delete, in whole or in part, content that – in our discretion – violates this agreement or may
damage the reputation of the service.
3- When you communicate with our customer representatives, you agree to behave in a respectful
and friendly manner. If we determine that your behaviour towards our customer service
representatives or other employees can at any time be perceived as threatening or offensive, we
reserve the right to immediately delete your account.
4- In consideration for Serious Dating granting you permission to use the Service, you agree that
we, our affiliates and our third party partners may place advertisements on the Service. By
submitting suggestions or feedback to Serious Dating relating to our Services, you agree that
Serious Dating may use and share such feedback for any purpose without compensating you in
any way.
We ask that you keep in mind that Serious Dating may access, store and disclose your account
information and content if required by law, in performance of Serious Dating’s agreement with you,
or in the good faith belief that such access, retention or disclosure meets a legitimate interest,
including to: (i) comply with legal process; (ii) perform the Agreement; (iii) respond to allegations
that any Content infringes the rights of third parties; (iv) respond to your customer service requests;
or (v) protect the rights, property or personal safety of the Company or any other person.
9- Community regulations
As long as you use the Service, you promise not to:
1- Use the Service for purposes that are illegal or that violate this Agreement.
2- Use the Service for any harmful or criminal purposes.
3- Use the Service to harm Serious Dating.
4- Violate the applicable Community Rules at any time.
5- Spam, solicit money from, or defraud other members.
6- Impersonate another person or legal entity or publish images of another person without their permission.
7- Bully, stalk, intimidate, abuse, harass, mistreat or spread false rumours about any person.
8- Post content that infringes or violates any person’s rights, including the right of public access, the right to privacy, copyright, trademark right, or other intellectual property or contract rights.
9- Post content that includes hate speech or threatening, sexually explicit or pornographic content; content that incites violence; or content that contains nudity, graphic content or violence.
10- Publish content that promotes racism, prejudice, hatred or physical harm of any kind against any group or individual.
11- Solicit passwords from other members for any purpose or solicit personally identifiable information from other members for commercial or illegal purposes, or disclose another Person’s personal information without that person’s permission.
12- Use another member’s account, share an account with another member, or have more than one account.
13- Create a new account if we have already deleted your account, unless you have obtained our permission to do so.
Serious Dating reserves the right to investigate and/or delete your account, without you being
entitled to refunds of any purchases you have made, if you violate this Agreement, abuse our
service, or behave in a manner that Serious Dating deems for being inappropriate or illegal; this
includes actions or communications that occur on the Service or elsewhere. If you violate these
rules or the Community Guidelines, your authorisation to use the Service will be automatically
revoked.
10. The Content of Other Members.
Although Serious Dating reserves the right to review and remove content that breaks this
Agreement, Serious Dating cannot ensure that all content will abide by this Agreement as it is
solely the responsibility of the user who posted it. Please report any content that you find on the
Service that you believe to be in violation of this Agreement via the Service or our contact page.
Purchase.
In general. From time to time, Serious Dating offers products and services (“in-app purchases”)
that can be purchased through the App Store, Google Play Store, your mobile carrier, directly in the
app, or through other payment methods approved by Serious Dating. If you choose to make such
an in-app purchase, you will be asked to confirm your purchase via the payment provider, after
which you will pay for the purchase using your chosen payment method, i.e. your card or a third
party account, such as Google Play or the App Store, (your “Payment Method”), at the price
indicated for the service(s) you have selected, as well as the amount of VAT or other similar taxes
and duties applicable to the purchase . With this Serious Dating or third party account, you
authorise us to charge you this amount.
A. Automatic renewal, automatic card payments.
Subscriptions renew automatically until you terminate or cancel the subscription. When you
purchase a subscription, your payment method will be charged monthly in advance within 24 hours
of the date of the initial purchase, at the price you agreed to when you created your subscription.
Your card details are stored and subsequently used for the automatic card payments in
accordance with the agreement.
After each payment, you will receive a receipt by e-mail. Objections to an already made paymen
should be directed to our Customer Service if you were charged directly by Serious Dating, or
through the relevant third party account (e.g. App Store). You can also object by contacting your
bank or payment provider, who can provide you with further information about your rights, as well
as the applicable deadlines.
You can unconditionally withdraw your consent to automatic card payments at any time by
changing your settings on Serious Dating or the relevant third party account. However, be aware
that you are still obliged to pay any outstanding amounts.
B. Changing or cancel your subscription’
If you wish to change or cancel your subscription, you must log into your third-party account (or go
to your Serious Dating account settings) and follow the instructions to cancel or cancel your
subscription, even if you have deleted your account or the Serious Dating application on your unit.
Deleting your account with Serious Dating, or deleting the Serious Dating application from your
device, does not terminate or cancel your subscription. Serious Dating will retain all funds charged
to your Payment Method until you terminate or cancel your subscription with Serious Dating or the
Third Party Account, as applicable. If you terminate or cancel your subscription, you may use your
subscription until the end of your then-current subscription period, and your subscription will not be
renewed after the time the current period expires.
C. As a rule
Charges for purchases are non-refundable, and in addition, it is not possible to receive a refund or
credit for partially used subscription periods. We may make an exception if a refund is requested
for a subscription offer within fourteen days of the transaction date, or if the law in your jurisdiction
allows refunds.
Subscribers resident in the EU or EEA are entitled, without reason and in accordance with local
law, to a full refund within 14 days of the start of the subscription. Note that this 14-day period
begins at the same time as the subscription.
Purchases of virtual goods are FINAL AND NON-REFUNDABLE.
How to request a refund:
If you purchased your subscription using your Apple ID, refunds are processed by Apple, not
Serious Dating. To request a refund, go to the App Store, click on your Apple ID, select “Purchase
History,” find the transaction, and tap “Report Problem.” You can also submit a request at https:/
getsupport.apple.com.
If you have made a purchase with your Google Play Store account or directly through Serious
dating, please contact our Customer Service with your order number from the Google Play Store,
(you can find the order number in the email with your order confirmation or by logging into Google
Pay ) or Serious Dating, (you can find this in your confirmation email). You can also write an email
or send a signed and dated message in which you, the buyer, cancel this agreement, or write a text
that has the same effect. This message should be sent to: Serious Dating head office Address.
D.Prices.
Serious Dating runs a global business and our prices vary depending on a number of factors. We
often offer promotional pricing, which may vary by region, subscription duration, package size, and
ore. We also regularly test new features and payment options.
11. Notices and Procedures for Claims of Copyright Infringement.
A- If you believe that your work has been copied and submitted to the Service in a manner that constitutes copyright infringement, please submit a request for the work to be removed using the form found here. If you contact us regarding an alleged copyright infringement, please include the following information:
B- an electronic or physical sub-switch by a person authorised to act on behalf of the owner of the copyrighted interest;
C- a description of the copyrighted work that you claim has been infringed;
D- a description of where the material that you claim is infringing is located on the Service (such description must be sufficient and thorough to enable us to locate the allegedly infringing material); your contact details, including your address, telephone number and email address,
E- a written statement by you that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law.
F- a statement by you, under penalty of perjury, certifying that the above information in your statement is accurate and that you are the copyright owner or that you are authorised to act on behalf of the copyright owner.
Repeat offenders usually have their accounts deleted.
11. Disclaimers.
SERIOUS DATING PROVIDES THE SERVICE “AS IS” AND “AS AVAILABLE” AND TO THE
EXTENT PERMITTED UNDER APPLICABLE LAW, MAKES NO WARRANTIES OF ANY KIND,
DISCLAIMERS OR ANYTHING LIKE THAT REGARDING THE SERVICE (INCLUDING ANY
CONTENT ON THE SERVICE ), AND INCLUDING, WITHOUT LIMITATION, ANY IMPLIED
WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY OR OTHERWISE.
SERIOUS DATING DOES NOT REPRESENT OR WARRANT THAT (A) THE SERVICE WILL BE
AVAILABLE ON AN UNINTERRUPTED, SECURE OR ERROR-FREE BASIS, (B) THAT ALL
DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED, OR (C) THAT ANY
CONTENT OR INFORMATION YOU OBTAIN ON OR THROUGH THE SERVICE WILL BE
ACCURATE.
SERIOUS DATING ASSUMES NO RESPONSIBILITY FOR ANY CONTENT THAT YOU OR ANY
OTHER USER OR THIRD PARTY POSTS, SENDS OR RECEIVES THROUGH THE SERVICE.
MATERIALS DOWNLOADED FROM OR OTHERWISE PROVIDED THROUGH THE SERVICE
ARE ACCESSED AT YOUR OWN RISK AND AT YOUR SOLE DISCRETION.
13. Limitation of Legal Liability.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL, SERIOUS
DATING’S SUBSIDIARIES, EMPLOYEES, LICENSORS OR SERVICE PROVIDERS BE
LIABLE FOR INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR
PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION , LOSS OF PROFITS ,
WHETHER DIRECT OR INDIRECT, OR LOSS OF DATA, USE, GOODWILL, OR OTHER
INTANGIBLE LOSS, ARISING AS A RESULT OF: (I) YOUR ACCESS TO OR USE OF OR
YOUR LACK OF ACCESS TO OR USE OF THE SERVICE, (II) THE CONDUCT OR
CONTENT OF OTHER USERS OR THIRD PARTIES EXPERIENCED ON, THROUGH OR
AFTER USING THE SERVICE; OR (III) UNAUTHORISED ACCESS, USE OR
ALTERATION OF YOUR CONTENT, EVEN IF SERIOUS DATING HAS BEEN ADVISED
OF THE POSSIBILITY OF SUCH DAMAGES.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF
CERTAIN REMEDIES, SO SOME OR ALL OF THE EXCLUSIONS AND LIMITATIONS IN
THIS SECTION MAY NOT APPLY TO YOU.
14. Arbitration, a waiver of class actions, and a jury trial.
A-By using the Service, regardless of how you use the Service, you agree to the above arbitration agreement. By doing so, YOU ARE ALSO WAIVING YOUR RIGHT TO COURT assert or defend any claims between you and the Company Serious Dating (except for actions that may be brought in small claims court). YOU ALSO WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS OR OTHER COLLECTIVE LEGAL PROCEEDINGS. Your rights will be determined by a NEUTRAL ARBITRATOR, NOT A JUDGE OR TRIAL, and the arbitrator will decide all questions regarding the arbitrability of the dispute. You are entitled to a fair hearing before the arbitrator. The arbitrator can award any relief that a court can, but you should remember that arbitration proceedings are usually simpler and more streamlined than lawsuits and other legal proceedings. Decisions made by the arbitrator are enforceable in a court of law and can only be overturned by a court on very limited grounds. For more information about the arbitration process, please read our Arbitration Procedures.
B- Any action to enforce this arbitration agreement, including any action to confirm, modify or reverse an arbitration award, may be brought in any court of competent jurisdiction. In the event that this Arbitration Agreement is challenged as having no effect, for any reason whatsoever, any legal action against the Company (except for small claims court actions) will be brought in the federal or foreign courts. You hereby irrevocably consent to the jurisdiction of these courts for such purpose.
C- The European Commission’s online dispute resolution platform is available at https://ec.europa.eu/odr. Serious Dating does not participate in dispute resolution procedures that take place before a consumer arbitration unit for members resident in the EU or EEA.
D- Users residing in the EU or EEA who are able to submit claims in their country of residence in accordance with applicable law, and claims that can be filed in a small claims court with competent jurisdiction in the municipality where the user resides.
15. Damages paid by you.
To the extent permitted by applicable law, you agree to indemnify, defend and hold
harmless Serious Dating, our affiliates and their and our respective officers, directors,
agents and employees from and against all claims, demands, demands, damages, losses,
costs, liabilities, and expenses, including attorneys’ fees, incurred, related to, or in any way
related to your access to or use of the Service, your Content, or your violation of this
Agreement.
16. The entire agreement; other things.
This Agreement, which includes our Privacy Policy, Cookie Policy, Safety Tips, Community
Guidelines and the [Arbitration Procedures], (if these apply to you, and any terms
disclosed to and accepted by you if you purchase additional features, products or services,
that we offer on the Service together constitute the entire agreement between you and
Serious Dating with respect to the use of the Service. If any provision of this Agreement is
invalid, the remainder of this Agreement shall remain in effect. If the Company does not
exercise or enforce any one or more of rights or provisions of this Agreement, this will not
constitute a waiver of such rights or provisions. You agree that your Serious Dating
Account is non-transferable and that all of your rights to your Account and Account Content
will terminate upon your death. Nothing agency, partnership, joint venture, management or
other special relationship or employment is created as a result of this Agreement, and you
may not make any representations on behalf of or bind Serious Dating in any way.
